Waiver Control:

 

BRI/ARC
All cargo destined for Angola needs to be accompanied by an import licence (BRI) and every bill of lading has to be accompanied by a loading certificate/ waiver (ARC number).

 

Type:
A loading certificate/waiver number known as the ‘Attestation de reservation de Calle’ [ARC] must be shown on all documentation related to the cargo shipped.
The responsibility relating to the issuance of the ARC and all costs is with the shipper. The ARC form is bought from the appointed CNCA agent at origin.

 

Legislation:
Angolan legislation in accordance with decree nr.19/94 dated 28/01/94, published in the Statue book D.R. 20/94 on 20/05/94 (effective as from 24/04/94). The intention of this legislation is to provide the Angolan Government and authorities with accurate information with respect to the cargoflow to and from their country.

Documentation Requirements:
The ARC number must be mentioned on the Bill of Lading [B/L] & the manifest. One ARC form is required per B/L. The ARC number takes the form of a ten digit number. No exceptions are made to the obligation of ARC, all companies, customers, NGOs, embassies are requested to arrange ARC, prior loading.

Given that penalties exist for non-compliance, it is very important that shippers ensure the correct procedures are adhered to. On the whole, approval is straightforward to obtain and waivers (loading certificates) are rarely, if ever, refused.

Requirements of shipper/ consignee:

1. The clearance of the cargo is impossible without a loading certificate and each bill of lading must correspond to one loading certificate.

2. The Angolan Shipper's Council (CNCA) or their agent are the only bodies authorised to issue loading certificates/ARC numbers.

3. The first step is that consignees must apply to the Ministry of Commerce 'to open' an Import Licence (BRI). This information is collated on computer and transferred to the CNCA.

4. Once cargo is ready, shippers should obtain a loading certificate blank form from CNCA or its agent at the loading port.

5. The shipper or his representative should fill in the required information on this document and give it back to the CNCA agent who will calculate the harbour and data processing dues and validate this information in the CNCA computer system.

6. Each loading certificate receives one serial number (ARC) and has to be duly dated, stamped and signed by the CNCA agent.

7. To receive this loading certificate, the shipper has to pay harbour and data processing dues as follows:

20ft containers - USD 100 per container
40ft containers - USD 200 per container

8. Harbour and data processing dues have to be collected at the moment goods have been loaded from port of discharge.

9. As per Decree nr.68/95 issued on 22/12/95 heavy fines/penalties and severe actions towards shippers and/or owners who are neglecting/avoiding the rules of the Angolese Legislation are now in force and fixed as follows: USD 5000.00 per incident plus 100% of all taxes to be paid to C.N.C.A

 

In case of transshipments it is compulsory to indicate the name of the first vessel and the name of the last vessel calling Angola.
- The loading certificate is to be type written (not hand written)
- One copy of Bill of Lading is to be supplied
